US Judge Orders Release of Abrego Garcia from Immigration Custody
A court has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment lacks lawful basis.
"Since his release after erroneous detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her ruling.
The case originates in a mistaken deportation to El Salvador earlier this year, which the government later admitted was an error. Following his return to the United States to face human smuggling allegations, he was held in federal detention.
In her order, the judge pointed out that the authorities does not have a valid deportation order, which prevents them from removing Mr. Abrego Garcia "at this juncture."

The court challenge center on conflicting assertions. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this claim.
