Spain's Attorney General Found Guilty in Controversial Leak Case

EPA

The nation's top prosecutor, Álvaro García Ortiz, has been compelled to step down after being convicted of revealing confidential information in a highly contentious case that has accentuated political divisions within the country.

Judicial Decision and Penalties

The Supreme Court determined that García Ortiz had unlawfully revealed details about the tax situation of businessman Alberto González Amador, who is the partner of a leading opposition figure.

The court handed down a 24-month prohibition from his position and a fine of €7,200. Additionally, he must compensate €10,000 to the businessman as compensation.

Political Consequences

The legal proceedings of García Ortiz intensified the previously strained relations between the progressive administration of Prime Minister Pedro Sánchez and the conservative political forces.

Contrasting positions were underlined by reactions to the guilty verdict.

"Sánchez must offer an apology to the Spanish people, resign and call elections, in that order," said Ester Muñoz for the main opposition party.

The government stated it did not agree with the ruling but respected it and would move forward with the selection of a new attorney general.

Judicial Dispute

Nevertheless, numerous politicians on the left expressed anger at what they perceived as a decision influenced by politics.

Health Minister Mónica García, of the Sumar party, stated the guilty verdict dealt a "devastating impact to the principle of innocent until proven guilty" and compromised citizens' rights when it came to the rule of law.

Case Background

The complex case dates back to spring of 2024, when the prosecutor's department issued a press release indicating that Mr González Amador had requested a plea bargain after being discovered avoiding tax payments worth €350,951.

The statement rectified mistaken press reports stating that the prosecutor's department had initiated the settlement.

The source of the false information was the head of communications of the conservative regional president of Madrid.

Legal Proceedings

Mr González Amador filed a complaint against the attorney general, claiming his confidentiality was violated. The case against García Ortiz also included allegations of leaking information about the matter to the media.

Prosecutors pointed to the prosecutor's decision to replace his mobile device as incriminating.

Yet, there was no conclusive proof linking García Ortiz to the leak and several journalists testified during the proceedings that he had not been the source of their information.

Concerning the press statement, the attorney general stated he was simply correcting the inaccurate information.

García Ortiz can challenge the ruling.

Wider Political Implications

This comes as a significant setback for the national leader, who has been facing legal scrutiny on various fronts.

  • His brother is scheduled for court proceedings for influence peddling
  • The prime minister's spouse is being examined for her commercial dealings
  • Former party officials in the governing political organization are accused of overseeing a large-scale corruption operation
